General Terms and Conditions (GTC)
for the rental of holiday apartments via www.freenb-apartments.de


1. Scope

These General Terms and Conditions apply to all rental agreements for holiday accommodations offered on the website www.freenb-apartments.de, concluded between Saskia Lau, operating under the brand “Free'n'B Apartments” (hereinafter referred to as “Landlord”), and the guest (hereinafter referred to as “Guest”).


2. Conclusion of Contract, Advance Payments, Security Deposits

2.1 The presentation of the accommodations on the website does not constitute a legally binding offer but an invitation to book. By submitting a booking request, the Guest makes a binding offer. The rental agreement is only concluded upon receipt of the Landlord’s written booking confirmation.

2.2 The Landlord is entitled to request up to 50% of the total price as a deposit at the time of contract conclusion. For stays longer than 7 days, reasonable interim payments may be requested.

2.3 The Landlord may request a reasonable security deposit for the duration of the stay. This is due together with the balance payment and will be refunded within 7 days after proper return of the accommodation.

2.4 The Landlord may withdraw from the contract for good cause, e.g., in cases of force majeure, false information provided by the Guest, or if there are indications that the stay will significantly disturb the house peace (e.g., planned parties, illegal or discriminatory activities).


3. Prices and Payment Terms

3.1 All prices are final prices including statutory VAT (if applicable) and include all ancillary costs unless otherwise stated in the property description (e.g., final cleaning, tourist tax). In the event of changes to taxes, fees, and charges or the introduction of new taxes, fees, or charges previously unknown to the parties, the provider reserves the right to adjust the prices accordingly.

3.2 The provider is entitled to request a reasonable advance payment of up to 50% (deposit) from the Guest at the time of contract conclusion. The amount and due date of the advance payment will be communicated in writing in the booking confirmation and thus form part of the contract. For stays longer than 7 days, the provider is entitled to request interim payments for services already rendered. For short-term bookings (less than 30 days before arrival), the total amount is due immediately.

3.3 In the case of late check-out, the Landlord may charge 50% of the nightly rate until 1:00 PM and 100% of the nightly rate after 1:00 PM.

3.4 If payment deadlines are not met, the Landlord may withdraw from the contract and charge cancellation fees in accordance with clause 5.


4. Arrival and Departure

The holiday accommodation is available from 3:00 PM on the day of arrival. On the day of departure, it must be vacated by 10:00 AM at the latest, and keys must be returned as agreed. Any deviations require prior arrangement.


5. Cancellation by the Guest

The Guest may cancel at any time before the start of the trip in text form (e.g., email). The decisive factor is the receipt of the cancellation declaration.

Cancellation Fees:

  • Up to 60 days before arrival: free of charge or 10% of the total price
  • 59–30 days before arrival: 50%
  • 29–7 days before arrival: 80%
  • From 6 days before arrival or in case of no-show: 90%

The Guest retains the right to prove that the Landlord incurred no or significantly lower damages. Purchasing travel cancellation insurance is recommended.


6. No Right of Withdrawal

For rental agreements for holiday accommodations concluded for a specific date or period, there is no statutory right of withdrawal (§ 312g para. 2 no. 9 BGB).


7. Duties of the Guest / House Rules

7.1 The Guest undertakes to treat the accommodation and its inventory with care and to report any damages immediately.

7.2 The accommodation may only be occupied by the number of persons specified in the booking.

7.3 House Rules: The Guest is obliged to comply with the house rules (available in the accommodation and online under “House Rules”).

7.4 In case of violations—especially noise disturbances, parties, or unregistered additional guests—the Landlord may charge a reasonable fee (fee list also available online under “House Rules”).

7.5 The Guest must also report any damages to their own liability insurance and provide the Landlord with the insurance number and contact details.


8. Smoking Ban

All accommodations are non-smoking. Smoking in the rooms is prohibited. In case of violation, the Landlord may charge a flat fee of up to €200 for special cleaning and any loss of revenue, subject to proof of higher or lower damage.


9. Pets

Bringing pets is not permitted. In case of unauthorized pets, a cleaning fee of up to €50 may be charged.


10. Travel Restrictions

If official travel bans or comparable restrictions apply during the booking period, the Guest assures that the trip serves a legitimate purpose (e.g., business, medically necessary).


11. Liability of the Landlord

The Landlord is liable for the proper provision of the rental property. For property and financial damages, the Landlord is only liable in cases of intent or gross negligence, except for breaches of essential contractual obligations and for damages resulting from injury to life, body, or health.


12. Data Protection

Personal data will be processed exclusively for contract fulfillment and stored in accordance with statutory retention obligations (e.g., one year under the Registration Act, ten years for invoicing data). Further details can be found in the privacy policy here.


13. Final Provisions

13.1 Should any provision of these agreements be wholly or partially invalid, the validity of the remaining provisions shall not be affected. An appropriate provision that comes closest to the purpose of the invalid provision shall replace it. The same applies to obvious gaps in the contract.

13.2 The law of the Federal Republic of Germany applies.
